The FAA definition of an ultralight aircraft is set forth in (FAA regulation) FAR 103, which specifies that a powered ultralight as having:
• A single seat
• Less than 5 US gallons of fuel
• Empty weight less than 254 pounds
• Top speed of 55 knots ( 64 mph)
• Stall speed not to exceed 24 knots (27.6 mph)
• Fly only during daylight hours
• Fly only over unpopulated areas
